Article 1 - Definitions

Reflection period : the period within which the consumer can exercise his right of withdrawal;

Consumer : the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;

Day : calendar day;

Duration transaction : a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;

Durable data carrier : any means that enables the consumer or entrepreneur to store information that is addressed to him personally in a way that allows future consultation and unchanged reproduction of the stored information.

Right of withdrawal : the option for the consumer to cancel the distance contract within the cooling-off period;

Model form : the model form for withdrawal that the entrepreneur makes available that a consumer can complete when he wants to exercise his right of withdrawal.

Entrepreneur : the natural or legal person who offers products and/or services remotely to consumers;

Distance agreement : an agreement in which, within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement;

Distance communication technology : means that can be used to conclude an agreement, without the consumer and entrepreneur being together in the same room at the same time.

General Terms and Conditions : the present General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

3.1 These general terms and conditions apply to all agreements, orders and deliveries of products by SOUQI.

3.2 By placing an order with SOUQI, the customer agrees to these general terms and conditions.

3.3 Situations that are not regulated in these general terms and conditions must be assessed 'in the spirit' of these general terms and conditions.

3.4 Uncertainties about the interpretation or content of one or more provisions of our terms and conditions must be interpreted 'in the spirit' of these general terms and conditions.

Article 4 – Orders and delivery

4.1 The customer places an order by following the ordering process on the SOUQI website.

4.2 SOUQI will process and ship the order to the address specified by the customer as soon as possible, but no later than within 5 working days.

• Delivery takes place while stocks last.

4.4 All delivery times are indicative. The consumer cannot derive any rights from any stated periods. Exceeding a term does not entitle the consumer to compensation.

4.5 If delivery of an ordered product proves impossible, SOUQI will make every effort to make a replacement item available. No later than upon delivery, it will be stated in a clear and understandable manner that a replacement item will be delivered. For replacement items right of withdrawal can not be excluded. The costs of any return shipment will be borne by SOUQI.

4.6 The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery

Article 5 – Prices and payment

5.1 All prices on the SOUQI website are stated in euros, including VAT and excluding shipping costs.

5.2 Payment must be made via the payment options offered on the SOUQI website.

5.3 SOUQI reserves the right to adjust prices at any time. This adjustment does not affect orders already placed.

5.4 All prices are subject to printing and typographical errors. For the consequences

No liability is accepted for printing and typographical errors. In the event of printing and typographical errors, the entrepreneur is not obliged to deliver the product at the incorrect price.

5.5 The consumer has the obligation to immediately report any inaccuracies in payment details provided or stated to the entrepreneur.

5.6 In the event of non-payment by the consumer, the entrepreneur has the right, subject to legal restrictions, to charge the reasonable costs communicated to the consumer in advance.

Article 6 – Returns and right of withdrawal

6.1 The customer has the right to return the ordered products within 14 days of receipt, without giving a reason.

6.2 If the customer wishes to exercise the right of withdrawal, he must inform SOUQI of this in writing. The customer can use the model withdrawal form available on the SOUQI website for this purpose.

6.3 Returned products must be unused, undamaged and in the original packaging.

6.4 The costs for returning are borne by the customer, unless SOUQI has made an error during delivery.

Article 7 – Warranty and liability

7.1 SOUQI guarantees that the delivered products meet the requirements of usability, reliability and conformity.

7.2 SOUQI is not liable for damage arising during the use of the products, unless this damage is caused by intent or gross negligence on the part of SOUQI.

7.3 SOUQI's liability is in any case limited to the amount of the order.

Article 8 – Intellectual property rights

8.1 All intellectual property rights to SOUQI's products and website, including copyrights and trademark rights, belong exclusively to SOUQI or its licensors.

8.2 The customer is not permitted to use these intellectual property rights without prior written permission from SOUQI.

Article 9 – Complaints and disputes

9.1 Complaints about orders must be submitted to SOUQI in writing within 7 days of receipt.

9.2 The entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.

9.3 Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed answer.

9.4 In case of complaints, a consumer must first contact the entrepreneur. It is also possible to register complaints via the European ODR platform ( http://ec.europa.eu/odr ).

9.5 If a complaint is found to be justified by the entrepreneur, the entrepreneur will, at his option, replace or repair the delivered products free of charge.

9.6 The agreements and these general terms and conditions are exclusively governed by Dutch law.

9.7 Disputes arising from the agreements and these general terms and conditions will be submitted to the competent court in Utrecht.

Article 10 – Privacy

10.1 SOUQI will process the customer's personal data in accordance with applicable privacy legislation. SOUQI's privacy statement is available on the website and provides a detailed explanation of how SOUQI handles personal data.

Article 11 – Final provisions

11.1 SOUQI reserves the right to change or supplement these general terms and conditions without prior notice.

11.2 If a provision of these general terms and conditions is void or voidable, the other provisions remain in full force.

11.3 These general terms and conditions come into effect on July 1, 2023 and apply to all orders from that date.
